Dear Mr. Jaitley,
I am addressing this letter to you as the Leader of Opposition in the Rajya Sabha.
I had refrained from joining issues with you till date as I did not wish to dignify your politically motivated, fallacious comments and utterances regarding the Gujarat carnage of 2002, but your latest blog dated January 07, 2014 has prompted me to write this brief letter to you.
As an eminent jurist and onetime Law Minister of this country you must be well aware that the issue regarding the role and culpability of your party’s prime ministerial candidate Mr. Narendra Modi is still at large before the Justice Nanavati and Justice Mehta Commision of Inquiry.
You might also be aware that the Honourable High Court of Gujarat while disposing my Writ Petiton (PIL) No. 216 of 2012 had recorded the assurance of the Learned Advocate General of the Gujarat State regarding production of 47 crucial contemporaneous documents/records before the Commission of Inquiry and had directed me to file a detailed affidavit before the Justice Nanavati and Justice Mehta Commission after accessing the said documents. Being one of the most prominent legal strategist of Mr. Narendra Modi you might also be aware that despite passage of nearly 15 months, the Modi Administration, with the indulgence of the Justice Nanavati and Justice Mehta Commission, has under one specious pretext or the other, avoided providing access to the said 47 documents/records till date; thereby effectively pre-empting the filing of my detailed affidavit as ordered by the Honourable High Court of Gujarat on 12/10/2012.
In view of these devious dilatory tactics, I have been constrained to move Miscellaneous Civil Application No. 2765 of 2013 in Writ Petition PIL 216 of 2012.
The above facts will clearly indicate to you that I am yet to file my detailed Affidavit before the Justice Nanavati and Justice Mehta Commission regarding the role of Narendra Modi and his Administration in the Gujarat Carnage of 2002 and consequently the issue regarding the role and criminal culpability of Mr. Narendra Modi is still at large before the Commission of Inquiry.
However, I am enclosing copies of my earlier Affidavits dated April 25, 2012 and May 29, 2012 filed before the National Commission for Minorities.[ Click on Dates to read ]
A mere reading of the said two Affidavits will bring out the role and conduct of Narendra Modi and his Administration in the Gujarat Carnage of 2002 as well as the mendacity and criminal complicity of the SIT in shielding Mr. Narendra Modi from criminal prosecution.
Please feel free to seek clarifications on any of the issues raised in this letter or in the Affidavits appended herewith.
It would also be my pleasure to have a national debate with you on any issue pertaining to the Gujarat Carnage of 2002 at a forum/venue and timing of your choice.
